Katz and Whitehead was responsible for creating new law in a case against the MBTA. The client was a Seventh Day Adventist who was denied employment at the MBTA because he refused to work on the Sabbath. More than 50 attorneys rejected his case. Katz and Whitehead took his case and represented him at the Mass Commission Against Discrimination and won. When the MBTA appealed the case, Katz and Whitehead defended the client in the Superior Court. Finally, Katz and Whitehead argued his case before the Supreme Judicial Court which resulted in a victory for the client.
